But I'm still not drinking beer tonight, which is just thoroughly depressing but the last thing I need after all this is booze on my stomach.

Watching Nero Wolfe, attempting to write. was lazy and spent most of the day in bed, but urgh didn't feel brave enough to try anything but water 'til eleven or so.

Okay, SMP story is going to get pwned goddammit.

*cries* I should have known the day couldn't go without something going wrong. Got something in the mail saying that a company bought my debt from Bank of America and now they have control of my debt except I don't have a debt I paid all mine off so I have no fucking clue where this all came from and fucking hell I dont' have that kind of money and could JUST ONE THING PLEASE GO RIGHT FOR ME.

I am so very tired of breathing.

It might be something called zombie debt. If I were you, I'd call Bank of America and have the fax verification that you paid the debt. Otherwise, get all the paperwork you still have about how you paid the debt. If anyone calls you, don't say anything to them about the debt and report them if they harass you. The article I linked to has a bunch of information on it and what you can do.

I don't think I have any paperwork. I was paying so many debts at once, at one point, and it was all most automatically taken out of my account....but I'll try. Who knows, maybe I'm just more of a fuck up than I thought and only think I paid it.

If you've paid your debt, then you should have documentary evidence of the same... cancelled checks, the actual "note" or loan agreement, which the first bank should have sent you when the loan was paid off, receipts...

No matter how electronic and advanced the world may be, banking of any kind produces a paper trail. It may very well be a pain in the ass, but don't panic. Write them. (Do NOT call. Calls are hard to document. You can take a photocopy of a letter, or archive a copy of a sent email. Send it 'receipt requested' by snail mail, or get a receipt via your email client....) Write the new company and state the facts: The debt they are referring to was paid off in full on thus and so date. Send a copy of the receipt if you have one - if you paid by check, you can send a copy of the cancelled check.

Scary and annoying, but relatively easy to deal with, aside from the entirely legitimate pain in the ass factor.

Feel free to email me if you want more details. After twenty years in the industry, I've never seen a sale of a loan portfolio or a computer conversion or a merger that wasn't a massive clusterfuck. Believe me, the buying bank should know this. There should be procedures and policies in place to deal with situations like yours.

Even if you paid it via direct debit from your bank, you should have records. The transactions will appear on your bank statements, and you can order copies of the statements if you no longer have the originals. (Hopefully, you're saving your bank statements. You need to keep any financial paperwork for at least seven years.)

Believe me - if you still owed the first bank money, they would have been contacting you...usually within ten days of a late payment, but always by thirty days past due.

I keep my bank statements. I'm sort of anal about it, though I seldom need them. the only thing I've found so far is payments to an atlantic credit company, and I don't remember now if that was the group that bought my barnes and nobles or the bank of america debt. I'll figure it out (I hope) because I know I paid all three of my debts off. I mean I'm not likely to forget an amount that big -__- I hope, anyway. But I'm nothing if not an idiot.

See, that's what I thought. I haven't been bothered by anyone in ages - not since the company that sued me. I had three debts - two I paid off with automatic payments, the last sued me and I sent the lawyer the checks. Argh.

It's probably best to just ignore them, especially since you know that you've paid off the debt. These companies rely on their ability to scare people into making mistakes, so DON'T PANIC. Get in touch with your bank and if needs be contact a solicitor.
